Welcome to RevForm! We're excited to have you on board.

These Terms of Service ("Terms") govern your access to and use of the websites, products, and services (collectively, the "Service") provided by MYST Studios ("RevForm," "we," "us," or "our").

Please read these Terms carefully. By creating an account, or by accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our Service.

1. Your Account and Team

1.1. Eligibility: You must be at least 18 years old and legally capable of entering into a binding contract to use the Service.

1.2. Account Security: You are responsible for safeguarding your account login credentials. You must notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your account.

1.3. Teams and Workspaces: Our Service is designed for collaboration through "Teams" (or "Workspaces").

• The user who creates a Team is designated as the "Owner" and has administrative control.
• The Team Owner is responsible for all activity that occurs within that Team, including all content created and all payments due.
• The Team Owner is responsible for managing invitations and access for other team members.

2. User-Generated Content

2.1. You Own Your Content: You retain all ownership rights to the content you create and upload to the Service. This includes, but is not limited to, your form designs, and all data and information submitted to your forms by your end-users (collectively, "User Content").

2.2. Our License to Your Content: In order to operate and provide the Service, you grant RevForm a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and transmit your User Content. This license is solely for the purpose of operating, improving, and providing the Service to you and your Team members.

2.3. Your Responsibility for Your Content: You are solely responsible for all User Content you create or manage. You represent and warrant that:

• You have all necessary rights and permissions to use and share your User Content.
• Your User Content does not violate any applicable laws or infringe on the rights of any third party (including privacy and intellectual property rights).
• You are responsible for handling all inquiries, disputes, or "right to be forgotten" requests from your own end-users (i.e., the people who fill out your forms).

3. Plans, Fees, and Payment

3.1. Plans: We offer a "Free" plan and one or more paid "Pro" plans. Features and limits for each plan are described on our website's Pricing Page.

3.2. Free Plan: Our Free plan may include certain limitations (e.g., submission limits) and may display a "Powered by RevForm" badge or similar branding on your public-facing forms.

3.3. Pro Plans:

• Billing: Subscriptions for Pro plans are billed in advance on a recurring monthly or annual basis. All subscriptions are tied to a specific Team, not an individual user.
• Auto-Renewal: Your subscription will automatically renew at the end of each billing cycle unless you cancel it through your Team's billing settings.
• Payment Processor: We use a third-party payment processor (Stripe) to handle all payments. We do not store or have access to your credit card details. By subscribing, you agree to Stripe's terms of service.
• No Refunds: All fees are non-refundable, except as required by law.
• Taxes: All fees are exclusive of any applicable taxes, levies, or duties, which you are responsible for paying.

4. Form-to-Invoice and Order Feature

Our Pro plans include a feature to convert form submissions into orders and generate invoices.

4.1. Our Role: RevForm acts only as a technical tool and a conduit to help you create and manage these orders and invoices. We use Stripe Invoicing to facilitate this process.

4.2. Your Responsibility: You are not a customer of RevForm in these transactions. The transaction is solely between you and your end-user (the form submitter). RevForm is not a party to, nor are we responsible for, any transaction you conduct with your customers.

4.3. You are solely responsible for:

• The accuracy, legality, and content of all orders and invoices you generate.
• The fulfillment and delivery of any products or services you sell.
• All customer service, disputes, chargebacks, and returns related to your orders.
• Complying with all laws and regulations related to your business, sales, and invoicing.

5. Acceptable Use Policy

You agree not to use the Service to:

• Upload, post, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
• Impersonate any person or entity or falsely state your affiliation with a person or entity.
• Engage in "phishing" or create forms designed to collect sensitive credentials (like passwords, social security numbers, or credit card details) in a deceptive manner.
• Send spam, unsolicited messages, or chain letters.
• Violate any applicable local, state, national, or international law, including data privacy laws.
• Reverse engineer, decompile, or attempt to extract the source code of the Service.
• Interfere with or disrupt the integrity or performance of the Service.

We reserve the right to suspend or terminate any account or Team that we believe, in our sole discretion, is violating this policy.

6. Termination

6.1. Termination by You: You can terminate these Terms at any time by canceling your subscription and deleting your account or Team.

6.2. Termination by Us: We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to, a breach of these Terms or a failure to pay subscription fees.

6.3. Effect of Termination: Upon termination, your right to use the Service will cease immediately. Your User Content may be permanently deleted. We will not be liable for any a-mount, and you will not be entitled to any refund for any prepaid subscription periods.

7. Disclaimers and Limitation of Liability

7.1. Disclaimer of Warranties: THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7.2. Limitation of Liability: TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL REVFORM, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; OR (C) YOUR TRANSACTIONS WITH YOUR END-USERS.

IN NO EVENT SHALL REVFORM'S AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100.00) OR THE AMOUNTS PAID BY YOU TO REVFORM IN THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.

8. Indemnification

You agree to defend, indemnify, and hold harmless RevForm and its affiliates, officers, agents, and employees from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with (i) your access to or use of the Service, (ii) your User Content, or (iii) your violation of these Terms.

9. General Terms

9.1. Modifications to Terms: We reserve the right to modify these Terms at any time. If we make material changes, we will provide you with reasonable notice (e.g., by email or an in-app notification). Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

9.2. Governing Law: These Terms shall be governed by the laws of Kanagawa Prefecture, Japan, without regard to its conflict of law provisions.
